Circumstances when workers compensation laws do not apply!
There are a few circumstances where these general Workers Compensation laws do not apply. Under the Federal Employment Liability Act, railroads who participate in interstate commerce can be held liable for employee injuries if their negligence is found to be a contributing factor to the employee's injury. The Merchant Marine Act provides identical protection to seamen. The Black Lung Act requires mine companies to pay disability payments to employees who have contracted "black lung" while working in the mines.
